I served the army 9 years and then 16 years in federal BOP. Now I am out of a job because I am taking heavy drugs for my back pain and my job found out and basically made me quit. I am currently trying to get my medical disability from the BOP. So right now I am just looking for things to keep my head above water. You had 3 years from the time you filed the income taxes on your SSB to file an amended return to get the taxes back after the VA started "paying" you. That time has long expired. The new law regarding this only goes back to Regarding paying back the SSB, again you are to "old". The new law affecting that also only goes for those from and newer. Regarding your back, you need to file for an increase from the VA.
You may qualify for Individual Unemployability if you cannot work at ANY job and you have a Dr that will state as such in writing. We cannot change previously issued R forms, nor can we recover any funds sent to the IRS to cover the taxes on the payments already made to you.
This is not a debt, but rather a recoupment. We are required by law to recoup these separation payments; therefore, we cannot consider waivers. You can request a more lenient repayment plan if you are experiencing financial hardship.
We will consider your application for hardship if the recoupment prevents you from meeting the costs necessary for essential subsistence. These essentials include food, housing, public utilities, clothing, transportation, and medical care.
Your notification letter will include a link to the Financial Statement of Debtor and a set of instructions. Please follow the instructions and return the completed Financial Statement of Debtor within 45 days of receipt of the letter to the address below.
